Berger Montague (Canada) PC Serving as Class Counsel to the Investors That Purchased Shares of Guyana Goldfields, Inc.

In a decision that may be the first of its kind, investors were successful in obtaining an order for third-party discovery prior to the completion of “leave to proceed” and certification of the claims and common issues. The Court agreed with the investors that this third-party had made communications that appeared to be highly probative and, as such, would be important for the case. Guyana Goldfields Inc. objected by arguing that the investors were attempting to circumvent Ontario discovery rules and historical practices under the Ontario Class Proceedings Act. “In these unique circumstances, the Court intervened to ensure that important evidence known to the parties was available to the plaintiffs at the pre-discovery stage” said Vincent DeMarco, the lawyer that made the submissions to the Court.

Guyana Goldfields Inc. is seeking to appeal the decision to the Divisional Court. The burden to appeal an interlocutory order is high and only granted in rare circumstances. The appeal will be heard in September 2025. If the motion court’s decision is upheld the investors should receive these records soon after. “These records will be a gamechanger and likely put the investors’ claims on the fast-track after years of delay from this motion,” said Andrew Morganti.
